Once the record is suspended, the convictions are concealed or “sealed” from the Canadian Police Information Center (CPIC) and will not appear on your Canadian RCMP police clearance certificate. This information may be revealed during court procedures and hearings, when entering the United States, as well as conducting a police clearance under the Privacy Act.

Generally speaking, individuals who meet the following eligibility is allowed to apply for a record suspension in Canada:

  • Must be over the age of 18;
  • Has a conviction under the Criminal Code of Canada; and
  • Have completed all sentences, including fines, paroles and probations

Additionally, there is a waiting time in which one can apply for a record suspension:

  • Summary offences: 5 years
  • Indictable offices: 10 years

After the application is submitted to the Parole Board of Canada, turnaround time can range from 6 to 12 months. The decision whether a record suspension is granted or not, is ultimately up to the Parole Board.
